All About Mesothelioma Settlements

Friday, November 6th, 2009

Mesothelioma settlements can range anywhere from thousands of dollars to millions of dollars, and they’re important to know about because it’s rare that a lawsuit involving asbestos exposure and mesothelioma makes it to trial. The avenue of exposure and political climate in the region at the time can both be influential when it comes to mesothelioma settlements. The damage done to the victim as a result of asbestos exposure, the culpability of the defendant and the factors listed above are ultimately what the amount the mesothelioma settlement is dependent on. With mesothelioma settlements, all parties involved are able to avoid protracted legal battles.

What do Mesothelioma Settlements Account for?

Lost wages, pain and suffering and the cost of long-term medical treatment are all things that mesothelioma settlements must account for. And if mesothelioma resulted in a wrongful death, the settlement then must account for the deceased’s survivors’ pain and suffering, plus the funeral expenses.

What is Mesothelioma?

Mesothelioma is a rare form of cancer. Typically caused by asbestos exposure, mesothelioma does not have a cure. Asbestos is a naturally occurring fiber that, for decades, was used in the construction, shipbuilding and automotive industries. Since it can take decades after asbestos exposure for mesothelioma symptoms to become noticeable, many people fail to realize that asbestos exposure is the cause of their illness.

A deadly disease, mesothelioma develops very quickly — the life expectancy of a patient is typically just months. It is very important to diagnose mesothelioma as early as possible in order to maintain a relatively high quality of life.

Former Harrah’s Employee Files Asbestos Exposure Lawsuit

Friday, August 7th, 2009

A former employee of Harrah’s Hotel and Casino in Las Vegas says he is sick from asbestos exposure while on the job. His three-year-old son is suffering as well — his father says what’s in the boy’s lungs makes him have trouble breathing. The man is suing the resort for $10 million.

Asbestos exposure while on the job can be extremely dangerous, and it can result in Mesothelioma, a rare form of cancer that attacks the lining of various organs and areas of the body such as the heart, lungs and abdomen. There is currently no cure for Mesothelioma. Victims have to deal with economic hardship along with pain and suffering.

Used for many years in thousands of different products, Asbestos is a mineral that, when disturbed, releases tiny fibers that travel deep into the lungs when inhaled. In the lungs, these fibers can cause scarring, called asbestosis. Asbestos fibers can cause Mesothelioma along with lung, colon and larynx cancer. Damage caused by asbestos dust happens over many years, which explains why Mesothelioma and asbestosis are called progressive diseases.

According to a news story from Fox 5 Vegas, OSHA had warned Harrah’s about the dangers — a dozen serious violations involving asbestos are shown on inspection reports. The man filing the lawsuit said he thinks what made his son sick is that he brought the asbestos fibers home with him from work, probably on his clothing. He said in the story that every employee was affected, from housekeeping workers to cocktail waitresses to the customers, when they didn’t do the asbestos abatement.

Hiring a Mesothelioma Lawyer

Tuesday, May 12th, 2009

When hiring a Mesothelioma lawyer, there are several considerations to keep in mind to ensure that you find the best person possible to represent you. Those who are looking into hiring a Mesothelioma lawyer may be victims of it or the loved ones of a Mesothelioma victim. A rare form of cancer, Mesothelioma is also commonly called “asbestos cancer,” the reason being that asbestos exposure is the overwhelming cause of Mesothelioma in the U.S.

Though there is currently no cure for Mesothelioma, a victim may be able to sue the person or corporation responsible and get compensation to help cover the cost of medical bills and compensate for their suffering.

A Mesothelioma lawyer will give you expert guidance when it comes to handling  your case, working diligently and aggressively toward getting you the compensation you deserve for your pain and suffering.

A good Mesothelioma lawyer should have plenty of experience working on other similar cases and should be familiar with Mesothelioma victims’ rights. Examine the lawyer’s history and ask many questions such as how many Mesothelioma cases he or she has worked on and how many of those had positive outcomes. You’ll also want to ask about who exactly would be working on your case — the lawyer you are talking to, or another lawyer or even an assistant in the firm. Make sure you feel comfortable with the Mesothelioma lawyer you wind up hiring.

You should strongly consider hiring a Mesothelioma lawyer as soon as possible once you are diagnosed with Mesothelioma. Many states may put restrictions on time, and the Mesothelioma may also give you a limited time to act.
